1. Our Services

Applied Science Fitness provides online fitness services, which may include personalized training programs, calorie and macronutrient targets, nutrition guidance, progress tracking, coach messaging, exercise-form feedback, coaching support, educational resources and access to the Applied Science Fitness app.

The specific features and level of coaching support included in your service depend on the product or package you purchase and will be described at the time of purchase.

2. Eligibility

You must be at least 18 years old to purchase or use ASF services. By purchasing or using our services, you confirm that you meet this requirement.

3. Health & Fitness Disclaimer

ASF provides fitness, training and general nutrition guidance. Our services are not medical care and are not intended to diagnose, treat, cure or prevent any disease, injury or medical condition.

You are responsible for determining whether you are physically able to participate in exercise and for seeking advice from an appropriately qualified healthcare professional where necessary, particularly if you have an injury, medical condition or other health concern.

Exercise and changes to diet involve inherent risks. You agree to follow guidance responsibly, exercise within your capabilities and stop exercising and seek appropriate assistance if you experience pain, illness or concerning symptoms.

4. Your Responsibilities

When using ASF services, you agree to:

• Provide accurate and reasonably complete information relevant to the service we are providing.
• Tell us about relevant injuries, physical limitations or health conditions that may affect your participation.
• Use training and nutrition guidance responsibly and in accordance with your own capabilities.
• Use suitable equipment and exercise in an environment appropriate for the activity being performed.
• Keep your account and login information secure and not provide unauthorized access to your ASF account.
• Use ASF content and services only for your own personal, non-commercial use.

5. Pricing, Payments & Subscriptions

The price, currency, billing frequency, included services and any applicable minimum commitment will be displayed at checkout or otherwise clearly communicated before you purchase.

Payments are processed through Stripe. By purchasing a recurring service, you authorize the applicable recurring charges to the payment method provided until the subscription is canceled or the agreed commitment has been completed.

Open-ended subscriptions: Where a service is offered as a recurring subscription without a minimum term, it will continue to renew at the billing frequency shown at checkout until canceled. Cancellation prevents future renewals and does not ordinarily reverse charges already incurred.

Minimum-term or fixed-term services: Where a service is sold with a stated minimum commitment or fixed term, you agree to the full commitment disclosed before purchase. Paying in installments does not convert a fixed-term commitment into a month-to-month service.

We may change prices, packages or promotional offers for future purchases. Any change affecting an existing subscription will be handled in accordance with the terms applicable to that subscription and applicable law.

6. Cancellation

Open-ended subscriptions may be canceled to prevent future renewals. Unless otherwise stated at checkout, access will ordinarily continue until the end of the period already paid for.

Where you have purchased a service subject to a clearly disclosed minimum or fixed-term commitment, cancellation does not automatically remove payment obligations for the agreed term.

We may consider early termination of a fixed-term commitment in exceptional circumstances, including a documented medical condition that makes continued participation impossible, or where ASF is unable to provide the material service purchased.

7. Refunds

Except as set out in clause 7.1, because ASF provides digital services, personalized programming and coaching resources that may begin shortly after purchase, payments already made are generally non-refundable for change of mind, unused time or failure to use the service.

7.1 14-Day Money-Back Promise. Where our 14-day money-back promise is displayed on the page from which you purchased, you may request a full refund of your first monthly ASF App payment if all of the following apply:

• you completed your Welcome Questionnaire;
• within 14 days of your purchase date, you logged at least 4 workouts in the ASF App and logged your food or your steps in the ASF App on at least 7 different days; and
• you email support@appliedsciencefitness.com requesting a refund within 14 days of your purchase date.

We will confirm eligibility using your account and app activity records. Approved refunds are made to your original payment method and your subscription will be canceled. This promise applies only to your first payment and does not apply to renewals or other ASF services. It does not affect any rights you have under applicable law.

7.2 90-Day Progress Guarantee (ASF Coaching). Where our 90-Day Progress Guarantee is displayed on the page from which you purchased ASF Coaching, if you follow your plan for your first 3 months and have not made measurable progress, we will provide your next 3 months of ASF Coaching free of charge, if all of the following apply:

• you have paid for 3 consecutive months of ASF Coaching;
• you followed your plan throughout those 3 months, meaning you submitted all weekly check-ins, logged at least 90% of your workouts in the ASF App, logged your food in the ASF App on at least 6 days each week, and hit your step target on at least 5 days each week;
• you did not make measurable progress, as agreed with your coach at onboarding (for a fat loss goal: a lower 7-day average bodyweight or a smaller waist measurement than at the start); and
• you email support@appliedsciencefitness.com to make your claim within 14 days of the end of your third month.

Your coach will assess whether you followed your plan using your ASF App data. The guarantee does not apply where a medical condition, medication or pregnancy affects your progress. It provides free coaching, not a refund, and does not affect any rights you have under applicable law.

Nothing in these Terms excludes or limits any refund, cancellation or other consumer right that cannot lawfully be excluded under applicable law.

If you believe the service supplied materially differs from what you purchased, has not been provided as agreed, or you otherwise believe you are legally entitled to a refund, please contact us at support@appliedsciencefitness.com .

8. Individual Results

The client results and testimonials featured by ASF reflect the genuine experiences and outcomes of those individuals.

Results vary from person to person and depend on factors including starting point, consistency, training effort, nutrition, lifestyle and adherence to the program. Past client results should not be taken as a guarantee of any specific individual outcome.

9. Intellectual Property

Training programs, exercise content, videos, guides, educational materials, graphics, written content and other ASF materials are owned by or licensed to ALSANA MANAGEMENT L.L.C-FZ and are provided for your personal use.

You may not reproduce, distribute, sell, publish, share or commercially exploit ASF content without prior written permission.

10. App & Service Availability

We aim to keep ASF services available and functioning reliably, but uninterrupted access cannot be guaranteed. Access may occasionally be affected by maintenance, technology providers, updates, outages or circumstances outside our reasonable control.

We may make reasonable updates or improvements to the app, features, resources and delivery of our services from time to time, provided that this does not remove material services already purchased without an appropriate remedy where required by law.

11. Suspension or Termination

We may suspend or terminate access where reasonably necessary, including for non-payment, misuse of the service, sharing of account access, abuse or harassment, unlawful activity, infringement of our intellectual property, or material breach of these Terms.

Termination by ASF does not affect any rights or obligations that accrued before termination, subject always to applicable consumer law.

12. Limitation of Liability

To the fullest extent permitted by applicable law, ALSANA MANAGEMENT L.L.C-FZ will not be responsible for indirect or consequential loss arising from your use of ASF services.

ASF is not responsible for injury or loss resulting from information you fail to disclose, failure to follow reasonable instructions, improper exercise technique, unsuitable equipment or environment, or use of the service in a manner inconsistent with the guidance provided.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices or legal requirements.

Changes will apply from the effective date stated in the updated Terms. Where required, material changes affecting an existing paid service will be communicated appropriately.

15. Governing Law

These Terms are governed by the applicable laws of the United Arab Emirates. Nothing in these Terms removes any mandatory consumer rights that apply to you under applicable law.
